A retired farmer wanted to sell the wooded back of his farm but keep his house, his lane and the open field by the road. A leased cell tower stood right where the new line had to go.
The tower lease gave the tower company a right of first refusal on any sale and an option to buy the tower site at the end of the lease. So we read the 1994 and 2008 lease documents, sent the sale to the tower company, and got its right of first refusal waived in writing on June 4, 2026.
Then the surveyor found that the 1994 lease and the 2008 lease put the tower site in two different places, about 25 feet apart. We had both drawn, kept the new line 60 feet clear of the 2008 lease area, and kept every guy-wire anchor inside the land being sold. The survey also turned up two small family cemeteries, one fenced and one unmarked, which were mapped and stayed with the land.
The county approved and recorded the plat in August, creating a 66.755-acre tract. It sold whole to the neighbouring family, whose own lot adjoins it. Afterward we paid to haul off a pile of old tractor tires behind the field, as we had promised the seller.

Exemption plat by Odom Land Surveying, Kenneth W. Odom Jr., PLS-3652, dated July 21, 2026 and revised August 3, approved by the Warren County Planning Director and recorded August 11, 2026 at Plat Book 402 Page 16 (see the plat). The sold tract is 66.755 acres including the cell tower lease areas and cemeteries, excluding right of way. The seller kept 18.398 acres with the house and the field by the road.
Memorandum of lease to American Towers, recorded April 3, 2008, Book 868 Page 21. A 49-year term from 2008. The lease site is about 3.46 acres, with a 20 ft access easement and a 10 ft utility easement. The tower company holds an option to buy the site at the end of the lease, and its lease rights carry on with the land.
The lease gave the tower company first refusal on a sale. It waived that right for this sale in a letter dated June 4, 2026, keeping its other lease rights.
The 1994 lease and the 2008 amendment describe the tower site about 25 ft apart. The plat shows the 2008 lease area as the operative line and the 1994 area for reference, with a neutral note on the difference. The new boundary is 60 ft clear of the 2008 area, and every guy anchor is inside the land sold.
Two small family cemeteries inside the tract, one fenced and one unmarked, with a willow standing over the older graves. Both are shown on the recorded plat and stayed with the land.
Title commitment, August 2026. Exceptions: the plat matters, the state road right of way, a telephone easement, an older access easement, and the tower lease.
Frontage on John Skinner Rd (NCSR 1350), paved, 60 ft right of way. The seller added about half an acre of road frontage so the tract has its own way in from the road, besides the tower's access easement.
No soil, perc or flood work is in our file. Mostly pine and hardwood with part of the field in crops.

Odd lots, divided parcels, land with a question hanging over it: that is most of what we buy. We do the survey, the soil work and the calls to the city and county ourselves, and we put what we find in writing.
