A one-third-acre lot in a lake community that its long-time owner had tried and failed to sell. A prior buyer's builder had walked away over the slope and how close the lot sits to the creek at the back.
We found out why from the community office: a house has to sit 50 feet off the stream at the rear, plus the front and side setbacks, so only a certain size of house fits. The soil map shows sloping clay loam, which makes the septic the open question.
The lot also carried several years of unpaid association dues and county taxes. We paid them off at closing to get clean, insured title.
The natural buyer was the owner of the lot next door. We wrote to him with the slope, setback and soil findings and the case for joining the two lots into one home site of about three-quarters of an acre. He bought it.
The diligence file as it stood at closing, including anything still open.
Lot 1998, Plat of Lake Sagamore Subdivision, Plat Book 12 Page 60, Franklin County Registry. Parcel 022386. Title insured at our purchase.
Lake Royale community office: a house must sit 50 ft off the stream along the back of the lot, plus front and side setbacks (by phone, 2024). Not in writing in our file.
Mapped as Tatum loam, 10 to 15 percent slopes: silt loam over clay loam, weathered bedrock around 50 in. No perc test was done while we held it.
At our purchase we paid the association's back balance and three years of delinquent county taxes (2021 to 2023), so the lot changed hands clean. The association carries over to any owner.
The owner of the adjoining lot, giving him about 0.76 acres across the two lots.

Odd lots, divided parcels, land with a question hanging over it: that is most of what we buy. We do the survey, the soil work and the calls to the city and county ourselves, and we put what we find in writing.
