The land itself was straightforward: a flat 27 acres, timbered about ten years ago and growing back, with about 840 ft on a paved county road and power on poles along the front. A buyer was under contract within two weeks.
The title was the hard part. The deed was in the names of the owner and his late wife. There was a will leaving the land to him, but it had never been probated, so nobody could sign a clean deed.
So the closing attorney opened the estate in Dodge County Probate Court. Both sons acknowledged service, one of them from Canada through a US consulate. The notice ran in the local paper for four weeks, the objection deadline passed, and the owner took his executor's oath before the probate judge by video. We extended the buyer's closing three times while that ran, and both closings went through on March 31, 2026, six days after the oath.
The diligence file as it stood at closing, including anything still open.

The deed was in two names and one owner had died in 2009. Her will left the land to her husband but had never been probated. The closing attorney filed the petition in Dodge County Probate Court; notice ran February 17 to March 10, 2026; the objection deadline was March 18; the executor's oath was taken March 25. Closed March 31, 2026. The deed out is subject only to easements for public roads and utilities.
About 840 ft on Rocky Springs Rd, a paved, striped, public county road. Power poles run along the frontage.
Dodge County, October 29, 2025: no zoning in rural Dodge County; a septic permit is required before a building permit. No HOA.
No perc or soil test was ever done, and the health department never returned our call. A home needs a well and septic.
Flat, cut over and growing back in young pine and hardwood, with mature pine plantation on the neighbouring tracts. No structures.

Odd lots, divided parcels, land with a question hanging over it: that is most of what we buy. We do the survey, the soil work and the calls to the city and county ourselves, and we put what we find in writing.
